PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents to rectify the four boundaries length mentioned in the FMB (mentioned as 104-Northern Side + 61.2-Eastern side + 104.6[77.8+26.8] -Southern Side + 64.6-Western side) equaling the extent (1 acres 90 cents = 77 Ares) mentioned in Sale Deed No.2257 of 1969, Patta No.2131, FMB in S.No.132/1B1, Kayalpattinam South Village, Tiruchendur Taluk, Thoothukudi District by considering the petitioner's representation dated 02.05.2025 within a period that may be stipulated by this Court. ORDER
The petitioner herein seeks a direction to the respondents to rectify the linear measurements found in the FMB pertains to the property situated in Survey No.131/1B1 in Kayalpattinam South Village, Tiruchendur Taluk, Thoothukudi District, by considering his representation dated 02.05.2025.
2. Heard the arguments of Mr.N.Pragalathan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional 2/6
Government Pleader, who takes notice for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3. According to the petitioner, he purchased 1 acre 90 cents in the above mentioned survey number under registered sale deed dated 29.09.1969. However, in the FMB, linear measurements are wrongly given. Therefore, the petitioner submitted a representation before the respondents on 02.05.2025 seeking rectification of linear measurements found in the FMB. The same has not been considered. Hence, the petitioner has come before this Court.
4. The learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner is under consideration by the first respondent and survey of the property is proposed to be conducted on 22.07.2025.
5. In view of the said statement by the learned Additional Government Pleader appearing for the respondents, without expressing 3/6
any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 02.05.2025 and pass final orders on its own merits within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and other interested parties.
6. With the above direction, this Writ Petition stands disposed of. No costs.
