PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, direct the second respondent herein to initiate appropriate Criminal action under the relevant provisions in law on the basis of of the complaint dated, 30.05.2025, within the stipulated time as fixed by this Court. The petitioner has lodged a complaint before the respondent police on 30.05.2025 and has filed this writ petition, seeking a direction to the respondent police to take action on her complaint.
2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the respondents submits that the marriage between the petitioner and her husband is second marriage for both of them and it was performed in the year 2020. The petitioner has lodged a complaint of cruelty, abuse and dowry harassment. He further submits that since it is a matrimonial dispute, the petitioner's complaint has been treated as a petition enquiry in CSR No.82 of 2025, dated 26.05.2025 and the issue has been referred to the Social Welfare Officer.
3.Recording the aforesaid submissions of the learned Additional Public Prosecutor, this writ petition is closed with a direction to this petitioner to appear before the Social Welfare 2/4
Officer and the respondent police shall also ensure that the opposite party/ the petitioner's husband is appearing before the Social welfare Officer and co-operate for the enquiry. The Social welfare officer is expected to conclude the enquiry, within a period of two weeks.
