PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the unauthorized construction made by the 5th respondent in Survey Nos.1146/1 and 952 at Kudankulam Village, Radhapuram Taluk, Tirunelveli District within the time frame stipulated by this Court.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This Writ of Mandamus has been instituted to direct the respondents 1 to 4 to remove the unauthorized construction made by the 5th respondent in Survey Nos.1146/1 and 952 at Kudankulam Village, Radhapuram Taluk, Tirunelveli District within the time frame stipulated by this Court. 2.The learned Government Pleader appearing for the respondents 1 to 4 would submit that survey is yet to be conducted. However, notice for conducting survey has been issued.

3.In view of the said factum, the respondents 1 to 4 are directed to complete the survey process, identify the unauthorized construction if any and thereafter, initiate enforcement action for removal of the unauthorized construction by following the procedures as contemplated under the relevant statutes and rules in force. The said exercise is directed to be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. 4.With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
