PRAYER: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the first respondent to dispose of the petitioner's appeal in Na.Ka.4580-2024G2 dated 31.10.2023 pending before the first respondent within a time to be stipulated by this Court. ORDER
This Writ Petition has been filed seeking the issuance of a writ of Mandamus directing the first respondent to dispose of the petitioner's appeal dated 31.10.2023.
2.Heard Mr.S.Pradeep, learned counsel for the petitioner, and Ms.K.Shiva Shankari, learned Counsel for the State, who accepts notice on behalf of the respondents 1 to 3.
3.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

4.Since no adverse order is proposed to be passed against the respondents 4 and 5, notice to the respondents 4 and 5 is dispensed with. 5.The learned counsel for the petitioner submitted that the petitioner had filed an application before the third respondent under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking maintenance and cancellation of the settlement deed under Section 23 of the Act. By order dated 28.11.2023, the second respondent allowed the petition and directed the fourth respondent to pay a sum of Rs.3,000/- per month and the fifth respondent to pay a sum of Rs.1,000/- per month towards the petitioner's maintenance during his lifetime.
Aggrieved by the failure of the authorities to grant complete relief, the petitioner preferred an appeal before the first respondent seeking appropriate relief under Section 23 of the Act, and the same is pending consideration. Thereafter, the petitioner submitted a representation dated 13.01.2025 seeking enforcement of the maintenance order and to dispose of the appeal. However, the said representation has not been considered till date. Aggrieved by the inaction on the part of the authorities, the petitioner has approached this Court by filing the present Writ Petition.
6.Considering the above facts and circumstances of the case, and without going into the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the petitioner's appeal in Na.Ka.No. 4580-2024G2, after affording sufficient opportunity of hearing to the petitioner, the respondents 4 and 5, and any rival claimants, if any, and pass appropriate orders on merits and in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order.
