JUDGMENT

When the matter was taken up for hearing on 29.08.2017, the learned counsel for the appellant filed a memo reporting 'no instructions'. After recording the memo, this Court directed the Registry to issue notice to the appellant. The notice sent to the appellant by the Registry was returned with an endorsement 'unclaimed''. There is no representation for the appellant. Hence, the Second Appeal is dismissed for default. No costs. Consequently, connected Miscellaneous Petition is closed.
