Prayer in WP(MD). 6275/ 2024 :
Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus calling for the entire records pertaining to the proceedings by the 1st respondent Ni.Mu.I/4482/2023, dated 30.01.2024 and quash the same as illegal and arbitrary and restore the patta in favour of the petitioner for the property comprised in S.No.251/1-1 acre 22 cent of Sankarankovil town
ORDER:- This Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.Mahaboob Fazil, Advocate for M/s.Roy and Roy Associates for the Petitioner this Court made the following order: By order dated 07.03.2205, the Writ Petition in W.P.(MD). No.6275 of 2024 was closed giving liberty to the petitioner to seek restoration of the Writ Petition. The earlier order came to be passed only on the ground that the learned counsel appearing for the writ petitioner was unable to get instructions from the petitioner, now the affidavit filed by the writ petitioner engaging the present learned counsel and seeks for the writ petition being restored.
2. In the light of the expressed liberty reserved in favour of the writ petitioner, I am inclined to allow the present Writ Miscellaneous Petition and the order in WP. (MD) No.6275 of 2024 dated 07.03.2025 is recalled and set aside. Accordingly, this Writ Miscellaneous Petition is allowed and the W.P. No.6275 of 2024, may be presented in the usual course as per roster.
