For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.60 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent Police for the offence punishable under Sections 379 of IPC r/w 21(1)(2) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.60 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner has illegally transported two units of river sand. Therefore, the present case came to be registered.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner is having two previous cases of similar in nature in (i) Crime No.20 of 2020 of Karaiyur Police Station, (ii) Crime No.60 of 2021 of Ponnamaravathy Police Station.

5. Considering the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
