PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, direct the learned Special Court for Trial of cases under SC/ST Act, II Additional District Court, Tirunelveli to accept the surrender of the petitioner and to consider the bail application to be filed by the petitioner on the same day in Cr.No.137 of 2026 on the file of the 1st respondent police. 1/4

ORDER

The present petition has been filed by the first accused in Crime No.137 of 2026 on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of surrender.

2. Considering the averments in the petition, there shall be a direction to the learned Sessions Judge, Special Court for Trial of cases under SC/ST Act, II Additional District Court, Tirunelveli, on or before 09.07.2026 and the learned Trial Court shall consider the bail application of the petitioner in Crime No.137 of 2026 on the file of the second respondent police and accept his surrender on the same day, after giving due opportunity to the defacto complainant.

3. With the above said observations, this Criminal Original Petition stands allowed.
