PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus to direct the respondents to provide electricity connection to the petitioner's house situates in Survey No. 161(2A1A1) in Block No. 78/6, Mariyamman Kovil Street, Mayanur, Krishnarayapuram Taluk, Karur District, based on the receipt of the payment in connection No.20006043012533 with a time frame fixed by this Court.

ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner and learned Standing Counsel for the respondents 1 and 2.

2. It appears that the petitioner has put up a construction, for which the petitioner has applied for EB connection, which has been rejected by the respondents 1 and 2, as according to the respondents 1 and 2, the construction of 2/5

the house is on the water body.

3. Considering the same, as (1) District Collector, Karur, (2) Rural Development Officer, Kulithalai, Karur District and (3) Tahsildar, Kulithalai, Karur District are the competent Authority to enquire the same, they are suo motu impleaded as the respondents 3, 4 and 5, respectively.

4. Mr.D.Ghandiraj, learned Special Government Pleader takes notice for the newly impleaded respondents 3, 4 and 5.

5. The newly impleaded respondents 3, 4 and 5 are directed to enquire as to whether the construction that has been put up is on the water body. In case the construction put up by petitioner is on the water body, the steps shall be taken to remove the encroachment. Otherwise, the petitioner shall be given EB connection by the respondents 1 and 2.

6. This exercise shall be completed by the respondents 3, 4 and 5 within a period of six (6) weeks from the date of receipt of a copy of this order. Thereafter, 3/5

further orders to be passed by the respondents 1 and 2, in case there is no encroachment on the water body.
