Mr.S.Vishnuvarthan, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.109/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ Accused who apprehends arrest at the hands of the respondent police for the offences under Sections 294(b), 323, 342 and 506(1) of IPC r/w Section 4 1/3

of TNPHW Act, in Crime No.109 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 27.06.2023, due to previous enmity, the petitioner who is the husband of the defacto complainant's sister, abused the defacto complainant with filthy language, assaulted the petitioner with wooden log and threatened him with dire consequences. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution.

4. Learned Additional Public Prosecutor would submit that a previous case is pending against the petitioner in C.C.No.14 of 2023. Another complaint has also been given by the defacto complainant's sister against the defacto complainant.

5. Considering the facts and circumstances of this case and considering the previous bad antecedent of the petitioner, this Court is not inclined to grant relief to the petitioner.
