This Criminal Original Petition has been filed to direct the respondent No.1 to withdraw the case in Crime No.161 of 2018 on the file of the respondent No.4 and entrust the same to the respondent No.2 for complete the investigation and file charge sheet within the time
2. The learned Government Advocate (Crl.side) appearing for the respondents submitted that on the complaint lodged by the petitioner, the case has been registered in Crime No.9 of 2017 for the offences under Sections 294(b), 341, 323, 324, 325, 327, 506(i) and 379 of IPC. Crl.O.P.(MD)No.5871 of 2018 thirty persons and about to file a final report. Therefore, at this stage, if the investigation is transferred to any other agency, the entire investigation would be affected.
3. Considering the above facts and circumstances of the case, the transfer of investigation cannot be considered at this stage. Hence, this Criminal Original Petition is dismissed. However, the fourth respondent is directed to complete the investigation and file a final report, within a period of four weeks from the date of receipt of a copy of this order. The third respondent is directed to monitor the investigation done by the fourth respondent and he shall ensure that the fourth respondent shall complete the investigation and file a final report within the time stipulated by this Court. Consequently, connected miscellaneous petition is closed.
