ORDER : The Court made the following order :- This Petition is filed to grant anticipatory bail to petitioner/Accused No.1 in the event of arrest in the criminal case of C.C.No.475 of 2012 in Crime No.170 of 2012 on the file of the respondent involving offence U/s.379 of IPC.

2. Heard the learned counsel on either side and perused the material records of the case.

3. It is seen that the case is of the year 2012. It is represented by the learned Additional Public Prosecutor that the NBW was issued on 24.07.2018 and the petitioner is the first accused in the case.

4. In view of the same, the petitioner has to file an application to recall the NBW by surrendering before the trial Court and the petition for anticipatory bail cannot be entertained by this Court.

5. Hence, this petition is dismissed. If the petitioner does not surrender, the respondent police should take immediate steps to apprehend the petitioner, if necessary by forming a special party also.
