The Second Appeal is directed against the judgment and decree made in A.S.No.56 of 2011 dated 28.02.2013 on the file of the Additional Subordinate Court, Kumbakonam, confirming the judgment and decree passed in O.S.No.236 of 2008 dated 21.06.2011 on the file of the II Additional District Munsif cum Judicial Magistrate Court, Kumbakonam.

2. When the matter is taken up today, there is no representation for the appellant.

It is seen that when the matter was taken up earlier, the appellant was directed to file an application for substitute service for the first respondent but the same was not filed and the counsel on record filed a memo reporting no instructions. Hence, the Registry was directed to print the name of the appellant in the cause list. Despite printing the name, there is no representation for the appellant. Accordingly, this Second 2/4
