For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.227/2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 4(1-A) and 4(1)(i) of TNP Act in Crime No.227 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused were found in illegal possession of 5 bottles of 180 ml old chef brandy with 11 plastic coups. Hence, the complaint. 3.The learned counsel for the petitioner would submit that based on the confession statement of the co-accused, the petitioner has been implicated as accused in this case. He would further submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he may be granted anticipatory bail.

CRL OP(MD). No.15820 of 2022 4.The learned Government Advocate (Crl. side) would submit that the petitioner is a habitual offender and he is having eight previous cases, which are similar in nature and the investigation in this case is pending. Hence, he strongly opposed for grant of anticipatory bail.

5.Considering the previous antecedents of the petitioner and also considering the fact that the investigation in this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
