The Second Appeal is directed against the judgment and decree, dated 18.11.2013 passed in A.S.No.79 of 2011 on the file Sub Court, Sankarankovil, modifying the judgment and decree, dated 23.02.2011 passed in O.S.No.61 of 2009 on the file of the Additional District Munsif Court, Sankarankovil.

2. When the matter is taken up for hearing today, the learned counsel appearing for the appellant would submit that the third respondent died and the appellant has not taken steps. Moreover, the learned counsel would 2/4

further submit that the appellant is not pressing the appeal and also made an endorsement to that effect.
