The Second Appeal is directed against the judgment and decree, dated 28.02.2013 passed in A.S.No.127 of 2010 on the file of the Principal 1/4
Subordinate Judge, Karur, confirming the judgment and decree dated 16.09.2010 passed in O.S.No.109 of 2008 on the file of the Principal District Munsif Court, Karur.
2. It is seen from the records that when the matter was taken up for hearing on 17.03.2026, the learned counsel for the appellant submitted that the appellant was reported dead and sought time for taking steps. When the matter is taken up for hearing today, the learned counsel for the appellant would submit that the appellant died on 03.03.2022 and the legal heirs of the deceased appellant are not willing to take further steps in the matter.
3. Recording the same, the second appeal is dismissed as abated. No costs.
