Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. LENIN KUMAR.T., Advocate for the petitioner in both CRL MPs and of Mr.B.THANGA ARAVINDH, Government Advocate (Crl. side) on behalf of the Respondent No.1 in both CRL Mps and of Mr.G.KARNAN, Advocate for the Respondents No.2 & 3 in Crl MP(MD) No.11773 of 2023 and for the Respondent No.2 in CRL MP(MD) No.11776 of 2023, the court made the following order:- These Criminal Miscellaneous Petitions have been filed to cancel the anticipatory bail granted to the respondents 2 & 3 in Crl.M.P(MD)No.11773 of 2022 and the second respondent in Crl.M.P(MD) No.11776 of 2022.

2.Since there was a dispute between the parties, the defacto complainant and his mother did not execute the sale deed for sale consideration of Rs.16,11,000/- and Rs.4,92,000/- respectively. Thereafter, the issue was compromised between the parties on certain terms. The defacto complainant paid a sum of Rs.2,50,000/- on 28.09.2021 and he agreed to pay the remaining amount within one month thereafter. However, the same is not paid till date. In the meanwhile, the petitioner filed a suit for declaration to declare the sale deed as null and void. Insofar as the conditions imposed by the Court below were duly complied with by the respondents.

3. In view of the above facts, this Court finds that no valuable grounds have been made out to cancel the anticipatory bail granted to the respondents respondents 2 & 3 in Crl.M.P(MD)No.11773 of 2022 and the second respondent in Crl.M.P(MD)No.11776 of 2022.
