ORDER

The petitioner herein seeks a direction to the first respondent to consider his representation dated 12.06.2025 for survey of the property situated in Survey No.26/35 with an extent of 1744 sq.ft in Ramarajapuram Village, Nilakottai Taluk, Dindigul District.

Heard the arguments of Mr.A.Jayaramachandran, learned counsel appearing for the petitioner, Mrs.K.Malathi, learned Additional Government Pleader, who takes notice for the first respondent and Mr.M.Vaikkam Karunanithi, learned Government Advocate (Criminal Side), who takes notice for the second respondent. Since no adverse order is passed against private respondent, notice to her is dispensed with By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, he purchased the subject property under registered sale deed dated 17.09.2010. Patta for the subject property was also issued in the name of the petitioner in Patta No.1348. The petitioner submitted an application for survey of the subject property and pursuant to the same, the first respondent issued survey notice on 10.02.2025. However, there was objections by the third respondent. Hence, survey could not been conducted. Therefore, the petitioner submitted a representation before the first respondent on 12.06.2025 seeking survey of the subject property with the help of the police protection if necessary. The same has not been considered. Hence, the petitioner has come before this Court.

4. The learned Additional Government Pleader appearing for the first respondent would submit that the representation submitted by the petitioner will be considered in accordance with law.

5. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 12.06.2025 and pass final orders on 3/6

its own merits within a period of eight (8) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, the third respondent, neighboring land owners and other interested parties.

6. With the above direction, this Writ Petition stands disposed of. No costs.
