PETITION FOR BAIL Under Sec.439 of Cr.P.C.
PRAYER :- For Bail in Crime No.142 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/A3, who was arrested on 19.09.2021 for the offence under Sections 379 r/w 34, 414 IPC, in Crime No.142 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 17.09.2021, the accused persons have stolen the two wheeler belonging to the defacto complainant and concealed the same. Hence, the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case, based on the confession statement of accused No.4. He would further submit that the petitioner is in custody from 19.09.2021 and hence, he seeks for grant of bail. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Additional Public Prosecutor would submit that totally there are seven accused in this case, they have illegally stolen the two wheeler and sold it on the same day. He would further submit that apart from this case, the petitioner has involved in two cases and the investigation in this case is yet to be completed. 5.Considering the nature of offence, the manner in which the occurrence had taken place and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed.
