PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to conduct to survey petitioners punja land to an total extent of 9.33.50 hectares situated survey Numbers 1306/5, 1308/1, 1308/2, 1309 and 1327 at Aayakudi East Village, Palani Taluk, Dindugal District, and lay the boundary stones based on his representation dated 23.12.2024, within the time limit that may be stipulated by this Court.

ORDER

The petitioner herein seeks a direction to the respondent to conduct survey of the property situated in S.Nos.1306/5, 1308/1, 1308/2, 1309 and 1327 in Aayakudi East Village, Palani Taluk, Dindugal District, by considering his representation dated 23.12.2024.

2.According to the petitioner, the subject property was purchased by one Sivanatham under sale deed dated 03.07.2023. Subsequently, the said Sivanatham executed the power deed in favour of the petitioner on 11.02.2025, empowering him to survey and look after the property. Based on the said power deed, the petitioner submitted an application to the respondents on 23.12.2024 in application No.2024/0123/13/008654, to survey the subject property. The same has not been considered. Hence, the petitioner has come before this Court. 3.The learned Additional Government Pleader appearing for the respondents would submit that the application of the petitioner will be considered in accordance with law.

4.In view of the same, without expressing any opinion on the merits of the matter, the respondents are directed to consider the application of the petitioner, dated 23.12.2024, and pass final orders on its own merits within a period of eight weeks from the date of receipt of copy of this order, after issuing notice to petitioner, neighbouring land owners and other interested parties. 5.With the above directions, the Writ Petition stands disposed of. No costs.
