PRAYER :- Writ Petition filed under Article 226 of Constitution of India, praying this Court to issue of Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order made in RC.No. 21636/NHIS-1/2021 dated 26.11.2021 issued by the 3rd respondent and quash the same and consequently direct the respondents to reimburse a sum of Rs.2,04,563/- to the petitioner within the time stipulated by this Court.

ORDER
The petitioner, who is a State Government employee, is the beneficiary under the NHIS. Her husband had affected due to COVID-19 and as such, he took treatment in Vyasini Hospital, Theni by incurring a sum of Rs.2,04,563/-. When the petitioner approached the respondents for medical reimbursement, the same has been returned. Challenging the same, the petitioner is before this court.
2. Heard the learned counsel for the petitioner, the learned Additional Government Pleader for the respondents 1 to 4 and the learned standing counsel for the 5th respondent. 2/5
3. When the matter was taken up for hearing, the learned counsel for the 5th respondent, on instructions, fairly conceded that as per G.O.Ms.No.165 dated 01.06.2022, if the petitioner furnishes the relevant documents, her claim could be considered under the purview of the said Government order.
4. In view of the said submission, this writ petition is disposed of with a direction to the petitioner to furnish the required documents to the 5th respondent and on receipt of the same, the 5th respondent shall consider the reimbursement in accordance with G.O.Ms.No.165 dated 01.06.2022. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. No costs. 04.06.2024 RR 3/5
