PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, the 3rd respondent herein to consider petitioner's representation, dated 31.05.2023 for revocation of the order of prolonged suspension and pass suitable orders by taking into consideration to relevant circumstances and pass such further or other orders as this Court. ORDER
The instant writ petition has been filed by an Assistant Executive Engineer working in the TANGEDCO, seeking a mandamus to consider his representation dated 31.05.2023 for revocation of his suspension order. 2.It could be seen from the typed set of papers that the petitioner was arrested in a trap case on 04.11.2019 and he was suspended on 05.11.2019. Thereafter, the petitioner has sent several representations to revoke his suspension. Ultimately, the respondents herein have passed an order on 31.05.2023 rejecting his request of revocation of suspension on the ground that since the petitioner is involved in a DVAC case and it should be treated as serious offence. However, the present petition has been filed seeking a 2/4
mandamus to dispose of his representation dated 31.05.2023 seeking revocation of suspension.
3.This Court is of the considered opinion that without challenging the order dated 31.05.2023, the question of issuing a mandamus to consider the representation of the writ petitioner dated 31.05.2023 does not arise. 4.In view of the above said facts, this writ petition stands disposed of with liberty to the petitioner to challenge the order dated 31.05.2023, if he is so advised. No costs.
