Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in OP.No.02/2022/A1 dated 22.7.2022 on the file of the Respondent no. 4 and quash the same as illegal and consequently for direction to the respondent nos.1 to 4 to protect the Petitioner and ensure the life and dwelling house and 2 shops of the petitioner in Door no. 130A, 131A Kodai Road, Main Road, Ammayanayakanoor, Nilakottai Taluk, Dindigul as per section 20 of Tamil Nadu Maintenance and Welfare of Parents and Senior Citizens Rules 2009.

ORDER

Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for R1 to R5.

2. The petitioner challenges the order passed by the Maintenance Tribunal.

3. As rightly pointed out by the learned Special Government Pleader, if the senior citizens feels aggrieved, he or she can file an appeal before the first respondent.

4. The petitioner is permitted to move the first respondent against the order impugned in the writ petition. As and when such an appeal is filed, the same shall be disposed of on merits and in accordance with law after notice to all the stake holders within a period of eight weeks thereafter.

5. With this liberty to the writ petitioner and direction to the first respondent, the Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
