O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the third respondent to conduct survey the petitioner land and fixed the boundary is situated in Survey No. 127/5B at Sirankattupatti Village, Natham Taluk, Dindigul District based on his representation dated 17.07.2023.

2. Heard the learned counsel for the parties and perused the materials available on record.

3.The learned counsel appearing for the petitioner submits that a representation dated 17.07.2023 was made seeking a survey of the subject property. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Additional Government Pleader appearing for the respondents submits that a civil suit was pending in respect of the subject land and that the civil court has held that the land belongs to one Mookan and not to the petitioner herein. He further submits that, however, after 2/5

considering the claims of all parties, appropriate steps would be taken in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the second respondent to consider and dispose of the petitioner's representation dated 17.07.2023, on merits and in accordance with law, after taking note of the civil court proceedings. Notice shall be issued to the petitioner and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of twelve weeks from the date of receipt of a copy of this order.
