ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 14.04.2026, for the offences punishable under Sections 103, 109, 126(2), 191(2), 191(3), 296(b) of BNS, in Crime No.123 of 2026 on the file of 1/4

the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is A4, he joining hands with other accused, way laid the deceased persons, namely Kadugu @ Muniyasamy and Mohankumar and attacked them with deadly weapons. The petitioner also attacked one of the deceased with iron rod. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that there is no specific overt act against the petitioner. He has been implicated based on the confession statement of the co-accused. He is in custody from 14.04.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioner.

4. The learned Counsel appearing for the State reiterated the prosecution case and reported that it is a case of double murder. The petitioner has five previous cases. Hence he strongly opposed the grant of bail to the petitioner.

5. This Court heard both sides and perused the materials available on 2/4

record.

6. Considering the facts and circumstances of the case, nature of offence, perusal of FIR shows that the petitioner is also actively participated and attacked the deceased with iron rod, so far no one was released on bail, investigation is also not yet completed, this Court is not inclined to grant bail to the petitioner.

7.Accordingly, this criminal original petition stands dismissed.
