ORDER
This Sub Application is filed to re-open the Contempt Petition in Cont.P.(MD)No.192 of 2025.
2. The petitioner was issued with a charge memo dated 03.06.2020. Therefore, the petitioner's name has not been included in the promotional panel. According to him, the crucial date was 15.03.2016 and at that time, there was no charge pending as against him. Challenging the deferred list published by the 1st respondent, the petitioner filed a writ petition before this Court in W.P.(MD)No.6058 of 2024, seeking a direction to the respondents to promote him as Superintendent on par with his batchmates for the panel year 2016-2017. This Court, by order dated 30.07.2024, allowed the writ petition by setting aside the impugned deferred list and also directed the respondents to include the petitioner's name in the promotional panel for the year 2016-2017 for the post of Superintendent.

3. Challenging the same, the respondents preferred a writ appeal in WA(MD)No.527 of 2025. A Division Bench of this Court, by Judgment dated 11.03.2025, dismissed the writ appeal, however, granted two months' time to implement the order passed in the writ petition. In the meantime, the petitioner has filed the above contempt petition in Cont.P.(MD)No.192 of 2025. Considering the order passed in the writ appeal, this Court, by order dated 08.04.2025, closed the contempt petition.

It appears that as against the dismissal of the writ appeal, the respondents have filed a Special Leave Petition before the Hon'ble Supreme Court in SLP(Civil) Diary No.55877 of 2025 and the same was dismissed by order dated 31.10.2025. In these circumstances, the petitioner has filed this sub application to restore the contempt petition.
5. Since it is reported that the order of this Court dated 30.07.2024 passed in WP(MD)No.6058 of 2024 has not been complied with, this contempt petition is restored on file.
