ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 06.02.2024 for the alleged offence under Sections 3, 4, 5(n), 5(i), 5(j)(ii), 6 of POCSO Act, 2012, in Crime No.2 of 2024, on the file of the respondent police, seeks bail.

2. The earlier bail petitions filed by the petitioner was dismissed on merits. This Court took into consideration the statement recorded from the victim under Section 164 of CrPC. There are no change in circumstances in this case and the case is now pending in Spl.S.C.No.153 of 2024 before the learned Sessions Judge, Special Court for Exclusive Trail of Cases under POCSO Act, Thoothukudi.

3. The learned Additional Public Prosecutor (Criminal Side), on instructions, submitted that the charges are yet to be framed in this case since the Court is awaiting for the DNA report.

4. The Trial has not even commenced before the Court below and also considering the manner in which this incident had taken place and considering the 2 earlier orders passed by this Court, this Court is not inclined to grant bail to the petitioner.
