PRAYER :- For Bail in Crime No.48 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners/A4 and A5 herein, who were arrested on 27.05.2023 for the alleged offence under Sections 302, 109, 201 of IPC, in Crime No.48 of 2023 on the file of the respondent police, seek bail.

2.The case of the prosecution is that the defacto complainant namely Murugesan who is relative of deceased Udhayakannan has given complaint that on 12.04.2023, the said Udhayakannan went to his work and thereafter, he has not returned to his house and on 26.05.2023 at about 6.15 a.m., the complainant's wife Mahalakshmi has informed him that the said Udhayakannan was laid on the road side with blood injuries in between Idaikattur to Periyakottai and his vehicle laid on that place in damaged condition. On suspicion that some one murdered the said Udhayakannan, the complainant lodged the complaint. 3.The learned counsel for the petitioner submitted that the petitioners are innocent persons and they were falsely implicated in this case and they have not committed any offence as alleged by the prosecution. 4.
The learned Additional Public Prosecutor submitted that the third accused moved a petition before this Court, seeking bail in Crl.O.P.(MD).No.13655 of 2023. That petition was dismissed on the ground that gruesome murder has been committed by the above said accused. So far these petitioners are concerned, they have stated to be the wife and daughter of the deceased. 5.The learned Additional Public Prosecutor would further submit that because of the illegal intimacy of the deceased with some other lady, trouble arose between them. These petitioners conspired with the co-accused and arranged accused No.
and committed murder of the deceased. Hence, he opposed the grant of bail. 6.Considering the period of incarceration and also considering the background facts in this case, this Court is inclined to grant bail to the petitioners on conditions. 7.Accordingly, the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Manamadurai, Sivagangai District, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 02/08/2023 / TRUE COPY / 02/08/2023 Sub-Assistant Registrar (C.S.)
