JUDGMENT

The Second Appeal is directed against the judgment and decree made in A.S.No.16 of 2012 dated 04.09.2013 on the file of the Subordinate Court, Uthamapalayam, confirming the judgment and decree passed in O.S.No.32 of 2011 dated 11.04.2012 on the file of the District Munsif Court, Uthamapalayam.

2. When the matter is taken up today, the learned counsel appearing for the appellant would submit that since the dispute was settled out of the Court, the appellant seeks permission of this Court to withdraw the second appeal and they have also circulated a letter to the Registry dated 18.03.2026 to that effect and also made an endorsement.

3. In view of the above, this Second Appeal is dismissed as withdrawn. Consequently, connected Miscellaneous Petition is closed. No costs.
