Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents 2 and 3 not to grant patta in respect of petitioner's property in T.S.No.1642/77, 86, situated at No.17/1, East Kakkan Nagar, Dindigul Town, Dindigul District, to the 4th respondent, on basis of the petitioner's representation, dated 29.01.2025.

ORDER

The petitioner herein seeks a direction to respondents 2 and 3 not to grant patta in respect of his property situated in T.S.No.1642/77 and 86 at No.17/1, East Kakkan Nagar, Dindigul Town, Dindigul District, to fourth respondent, by considering his representation, dated 29.01.2025.

According to the petitioner, the subject property has been in possession and enjoyment of his family for the past 50 years and the superstructure standing in the subject property was also assessed in the name of the petitioner's mother -Alagammal. Now, the fourth respondent, by producing some tax receipts, is attempting to obtain patta for the subject property in his favour. Therefore, the petitioner submitted an instant representation, dated 29.01.2025, before the second respondent, requesting him not to grant patta to the fourth respondent, based on the documents produced by him. The same has not been considered. Hence, the petitioner has come before this Court.

3. The learned Government Advocate, who takes notice for respondents 1 and 2, would submit that, as on today, there is no proposal to issue patta in favour of the fourth respondent.

4. In any event, while taking note of the submission made by the learned Government Advocate, appearing for the respondents 1 and 2, without expressing any opinion on the merits of the matter, the second respondent is directed to consider the representation of the petitioner, dated 29.01.2025, and pass final orders on its own merits and communicate the same to the petitioner within a period of eight weeks from the date of receipt of copy of this order, after affording reasonable opportunity to petitioner and fourth respondent.

5. Accordingly, the Writ Petition stands disposed of. No costs. 18.07.2025 NCC :
