Heard Mr.G.Radhakrishnan for the Petitioner, Mr.P.Gunasekaran, for the 1st Respondent and Mr.C.Jeganathan, learned counsel for Government of Tamil Nadu for the 2nd Respondent.

This Writ Petition has been filed for issuance of Writ of Mandamus, directing the Respondents, particularly the 1st Respondent, to consider the petitioner's representation dated 01.11.2023 along with the forwarded official processing document dated 21.11.2023 and consequently update/include the name of the Petitioner's second wife, Smt.P.Muniyammal, in the Pension Payment Order (PPO No.EP102010) as the eligible spouse for family pension.

Today, when the matter is taken up for consideration, it is brought to the notice of this Court by the learned counsel appearing on either side that the petitioner had earlier approached this Court seeking an identical relief by filing W.P.(MD) No.20625 of 2024. The said Writ Petition was disposed of on 30.08.2024, granting liberty to the petitioner to challenge the proceedings dated 20.12.2023 passed by the first respondent. However, instead of challenging the said proceedings, the 2/5

petitioner has filed the present Writ Petition seeking the very same relief. Therefore, this Court is inclined to dismiss the Writ Petition on the ground that the petitioner has failed to disclose the earlier order passed by this Court while filing the present Writ Petition.

4. At this juncture, the learned counsel for the petitioner sought permission of this Court to withdraw the Writ Petition with liberty to challenge the proceedings passed by the respondents.

5. In the light of the above, this Writ Petition is dismissed as withdrawn, with liberty to the petitioner to take appropriate steps to challenge the proceedings passed by the respondents, if so aggrieved, in accordance with law.
