PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the fair and decreetal order dated 12.06.2025 made in I.A.No.8 of 2024 in O.S.No.10 of 2024 on the file of the District Munsif Court, Mudukulathur.
For Petitioner : Mr.M.S.Jeyakarthik
ORDER
This Civil Revision Petition has been filed to set aside the fair and decreetal order dated 12.06.2025 made in I.A.No.8 of 2024 in O.S.No.10 of 2024 on the file of the District Munsif Court, Mudukulathur. 1/4
2. The first respondent herein filed a suit in O.S.No.10 of 2024 on the file of the District Munsif Court, Mudukulathur, seeking declaration and recovery of possession. Pending the suit, the petitioner and the second respondent filed a petition in I.A.No.8 of 2024 under Order VII Rule 11 CPC to reject the plaint. The said petition was dismissed on 12.06.2025. Aggrieved by the said order, the present Civil Revision Petition has been filed.
3. The learned counsel appearing for the petitioner submitted that the petitioner purchased the suit property from the father of the first respondent. It was further submitted that the petitioner had already filed a suit in O.S.No.39 of 2023 before the same Court, namely the District Munsif Court, Mudukulathur, seeking permanent injunction against the first respondent. Since both suits are pending before the same Court, the learned counsel requested that a direction be issued to the trial Court to dispose of O.S.No.39 of 2023 and O.S.No.10 of 2024 simultaneously.
4. Since no adverse orders are going to be passed against the respondents, notice to the respondents is dispensed with.
5. In view of the above, this Civil Revision Petition is disposed of with a direction to the trial Court to dispose of O.S.No.39 of 2023 and O.S.No.10 of 2024 simultaneously, within a period of one year from the date of receipt of a 2/4
copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
