ORDER

This Civil Revision Petition is filed seeking a direction to the learned Subordinate Judge, Thirumangalam, to expedite the proceeding pending in O.S.No.169 of 2023, to dispose of the same within a time frame.

2. Heard Mr.Baburajendran, learned Counsel for the petitioner. Since no adverse orders are going to be passed against the respondents, notice to the respondents is dispensed with.

3. The petitioner's case is that the suit filed by the deceased plaintiff in O.S.No.446 of 2005 was dismissed for default on 28.03.2012. The grievance of the petitioner is that although the judgment in the said suit attained finality, the disposed suit was later assigned with a new number to the disposed suit as O.S.No.169 of 2023. The learned counsel for the petitioner submits that even after service of notice, the said suit has been repeatedly adjourned on the ground of "await reply", without any substantial progress. Hence, he seeks expeditious disposal of the petition. 2/4

4.Considering the limited request of the petitioner, this Court directs the trial Court to dispose of the suit in O.S.No.169 of 2023, within a period of 12 months from the date of receipt of a copy of this order. 5.With the above direction, this Civil Revision Petition is disposed of. No costs.
