PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records connected with the notice in Na.Ka.No. 61 / Ka.Aa. / Va.Ka.Ni. / 2022 dated 27.08.2022 of the 2nd respondent and quash the same as illegal and direct the respondents to grant permission and protection for conducting Procession Vinayagar Idol in Dindigul District at any date as this Honourable Court may deem fit to the proper and circumstances of the case by considering the fresh representation of the petitioner, dated 27.08.2022.

O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of Writ of Certiorarified Mandamus, to quash the impugned notice in Na.Ka.No. 61 / Ka.Aa. / Va.Ka.Ni. / 2022 dated 27.08.2022 of the 2nd respondent and also sought for a direction to the respondents to grant permission and protection for conducting Procession Vinayagar Idol in Dindigul District at any date as this Court may deem fit to the proper and circumstances of the case, by considering the fresh representation of the petitioner, dated 27.08.2022.

2. Heard M/s.M.Benazir Begum, learned counsel appearing for the petitioner and Mr.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor appearing for the respondents.

3. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that the respondent police has prepared a plan for permitting the idol procession 2/5

through some non-problematic area and they have no objection to permit the idol procession in non-problematic area marked by the respondent police. The statement is recorded.

4. Recording the same, the 2nd respondent/Inspector of Police is hereby directed to consider the fresh representation of the petitioner, dated 27.08.2022 and permit the petitioner to conduct idol procession through the permitted route. The petitioner is directed to intimate the date, when they are conducting idol procession previously to the respondent police to provide necessary police protection.

5. With the above direction, this writ petition is disposed of. No cost.
