ORDER

The present petition has been filed seeking to set aside the summon issued by the first respondent herein on 18.06.2026, under Section 7 (C) of Tamil Nadu Prohibition of Harassment of Women Act, (Amended) 2025.

2. A perusal of the records reveal that the petitioner is arrayed as A1 in Crime No.297 of 2026 on the file of the second respondent police station for the alleged offence under Sections 126(2), 296(b), 74 and 351(3) of BNS, 2023. The FIR has been registered on 27.05.2026.

3. The present impugned summon has been issued by the first respondent on 18.06.2026 under Section 7 (C) of Tamil Nadu Prohibition of Harassment of Women Act, (Amended) 2025 calling upon the petitioner to appear on 22.06.2026.

4. The grievance of the petitioner is that at the time of appearance, the petitioner has been directed to produce two sureties along with original 2/5

documents. According to the petitioner, no such provision is found under Section 7 (C) of the above said Act and hence the summon is liable to be quashed.

5. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

6. A perusal of the impugned summon dated 18.06.2026 reveals that it is issued only under Section 7 (C) of Tamil Nadu Prohibition of Harassment of Women Act, not under Section 126 of BNSS. In such circumstances, the question of directing the petitioner to appear along with two sureties and original documents does not arise. However, considering the fact that already FIR has been registered as against the petitioner, the petitioner has to cooperate for the enquiry under Section 7 (C) of Tamil Nadu Prohibition of Harassment of Women Act.
