PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachments in Survey No.851 situated at Nagaiyakottai Revenue Village, Gujiliamparai Taluk, Dindigul District, based on the petitioner's representations dated 14.12.2024, 08.09.2025 and 29.10.2025 within a time frame to be fixed by this Court. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachments in Survey No.851 situated at Nagaiyakottai Revenue Village, Gujiliamparai Taluk, Dindigul District, based on the petitioner's representations dated 14.12.2024, 08.09.2025 and 29.10.2025 within a time frame to be fixed by this Court.

2. It is stated by the learned counsel for the petitioner that despite the authorities identified the encroachments in the abovesaid survey number, no action has been taken to remove the same.

3. Learned counsel for State, on instructions, would submit that the 2/5

encroachments are on State Highways and the authorities will remove the encroachments in the said survey number by due process of law within a time frame.

4. Recording the above submission, there shall be a direction to the authorities to make survey of the place in question in the presence of the parties concerned after putting them on notice. If the survey/inspection reveals any encroachment, the authorities shall take steps to remove the same by due process of law after giving opportunity to the parties concerned. Such an exercise shall be completed within a period of months from the date of receipt of a copy of this order.
