ORDER

The petitioner herein seeks a direction to the respondents to conduct survey of the property situated in Survey No.33/1A1A1 in Nilayur Bit-1 Village, Thirupparankundram Taluk, Madurai District, by considering her application dated 13.01.2025.

2. Heard the arguments of Mr.K.Appadurai, learned counsel appearing for the petitioner and Mr.A.Baskaran, learned Additional Government Pleader, who takes notice for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, she purchased 67 cents of land in the above mentioned survey number under registered sale deed dated 06.03.1992 and patta for the subject property was issued in Patta No.856. The petitioner submitted an online application on 13.01.2025 in 2/6

application No.2025/0123/24/011174 seeking survey of the subject property. The same has not been considered. Hence, the petitioner has come before this Court.

The learned Additional Government Pleader appearing for the respondents would submit that though the petitioner purchased 67 cents of land under registered sale deed, in the patta issued to the petitioner in Patta No.856, extent of purchase is mentioned as 14.08 Ares, which is roughly equivalent to only 34 cents. Since there is some discrepancy in the extent between the title document and the revenue document, there is difficulty in surveying the property.

In view of the said statement of the learned Additional Government Pleader, without expressing any opinion on the merits of the matter, the respondents are directed to consider the online application of the petitioner dated 13.01.2025 and pass final orders on its own merits within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, neighboring land owners and other interested parties. If the respondents decides to survey the 3/6

property, they can survey the property with reference to the four boundaries mentioned in the title document as well as with reference to the revenue document and file a report mentioning the same.

6. With the above direction, this Writ Petition stands disposed of. No costs.
