PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent No.1 and 2 herein to conduct survey and demarcate four boundaries in respect of the properties comprised in Sur.No.183/1C, 183/3, 183/4A1, 183/4B and 183/5A situated at Veppampatti Village, Uthamapalayam Taluk, Theni District, with the aid of the respondent No.3 and consequently direct the respondent No.1 and 2 to issue survey report within a stipulated time period in accordance with law on the basis of the application dated 03.07.2025.

ORDER

The petitioner herein seeks a direction to the respondents 1 & 2, to survey the property comprised in S.Nos.183/1C, 183/3, 183/4A1, 183/4B and 183/5A, situated in Veppampatti Village, Uthamapalayam Taluk, Theni District, by considering his application, dated 03.07.2025. 2.According to the petitioner, he claims right over the subject property under partition deed, dated 16.09.2016, and sale deed dated 27.07.2018. Patta issued in the name of the petitioner. He submitted two applications before the first respondent on 03.07.2025, in application Nos.2025/0123/25/005084 and 2025/0123/25/005086, seeking survey of the subject properties. The same has not been considered. Hence, the petitioner has come before this Court. 3.The learned Additional Government Pleader appearing for the respondents 1 and 2, would submit that the applications of the petitioner will be considered in accordance with law.

4.In view of the same, without expressing any opinion on the merits of the matter, the respondents 1 and 2, are directed to consider the applications of the petitioner, dated 03.07.2025, and pass final orders on its own merits within a period of 12(twelve) weeks from the date of receipt of copy of this order, after issuing notice to petitioner, co-pattadars, neighbouring land owners and other interested parties.

5.With the above directions, this Writ Petition stands disposed of. No costs.
