The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the second respondent to provide adequate police protection for the petitioner's life and limb as well as to survey and demarcate and to fix the boundary stones and fence the properties comprising in S.No.194/2B (0.07.5ares), S.No.194/3A1 (0.10.0ares) and a property in S.No.194/3B3A (0.23.5ares) situated at Manaviduthi Village, Pudukkottai District, by considering the representation given by the petitioner dated 23.08.2022.
2.The learned Additional Public Prosecutor would submit that apprehension of creating trouble by the private respondents, this https://www.mhc.tn.gov.in/judis 1/2
W.P(MD)No.21012 of 2022 petition is filed by the petitioner for measuring the property. Based upon the representation made by the petitioner, enquiry was undertaken. During the course of enquiry, the private respondents have also given a statement to the effect that they will not make any trouble to the petitioner to measure the property. 3.Perusal of records shows that he has also paid required fee for measuring the property. The Tahsildar, Pudukottai, may undertake to enquired the matter under Section 10 of Tamil Nadu Survey of Boundaries Act by summoning the private respondents namely, the respondents 3 & 4 and pass orders. If any trouble is made by the private respondents, the petitioner may file fresh representation to the second respondent. Depending upon the order of the Tahsildar, Pudukottai, the second respondent may consider the representation. The process shall be completed within a month from the date of receipt of a copy of the order of the Tahsildar. 4.With the above direction, this Writ Petition is disposed of. No costs.
