Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 to 3 to deposit the Compensation amount with interest in the Principal Civil Court under Section 3H of National Highways Act or to pay the determined compensation amount to the petitioner along with interest and statutory benefits for the acquired land of 4650 Sq Mtrs. of land in S.F.No. 88/2, Kirungakottai, Thoothikulam Village, Manamadurai Taluk. ORDER

The petitioner herein seeks a direction to the respondents 1 to 3 to deposit the compensation amount with interest in the Principal Civil Court under Section 3 H (4) of National Highways Act as there is a dispute between the petitioner and the 4th respondent in respect of the subject property which was acquired for extension of National Highways Act.

2. When the writ petitioner is taken up for hearing the learned Additional Government Pleader appearing for the respondents 1 and 2 circulated the award passed by the 2nd respondent in e.f.m3/76/2025 2/4

dated 05.03.2025, fixing quantum of compensation. In the said award, it is clearly mentioned by the 2nd respondent that in view of the dispute between the rival claimants, the award amount will be deposited before the Principal District Court, Sivagangai under Section 3 H (4) of the National Highways Act.

3. In view of the same, the respondents 1 and 2 are directed to make a reference under Section 3 H (4) of the National Highways Act and deposit the compensation amount before the Court of competent jurisdiction within a period of four (4) weeks from the date of receipt of a copy of this order.

4. The writ petition is disposed of with the above observations. No costs.
