PRAYER: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus to direct the second respondent herein to recover and remit the compensation amount with interest from the respondents 4 to 7 as per the orders passed in Na.Ka.Aa7/1571/23 dated 06.05.2026 passed by the third respondent herein and further direct the third respondent to disburse the said compensation amount to the petitioner herein within the time frame fixed by this Court.

ORDER
This Writ Petition has been filed seeking the issuance of a writ of Mandamus directing the second respondent to recover and remit the compensation amount, together with interest, from the respondents 4 to 7 in terms of the proceedings of the third respondent in Na.Ka.Aa7/1571/23 dated 06.05.2026, and consequently direct the third respondent to disburse the said compensation amount to the petitioner within such time as may be stipulated by this Court.

2.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself. 3.Heard Mr.K.R.Laxman, learned counsel for the petitioner, and Mr.M.Mahaboob Athiff, learned Counsel for the State, who accepts notice on behalf of respondents 1 to 3. Since no adverse order is proposed to be passed against the respondents 4 to 7, notice to them is dispensed with. 4.The learned counsel appearing for the petitioner submitted that the petitioner's husband, Hussain, was employed as a painter under respondents 4 to 7. While he was in the course of his employment, on 29.03.2017, he met with an accident, sustained grievous injuries, and subsequently succumbed to the same. Thereafter, the petitioner filed W.C.No.91 of 2017 before the Commissioner for Employees' Compensation, Madurai. Upon adjudication, an award dated 20.10.2022 came to be passed in favour of the petitioner. However, since the award amount was not paid by the respondents 4 to 7, the petitioner approached the third respondent 3/7
seeking recovery of the amount. Accordingly, the third respondent issued a Revenue Recovery Certificate and forwarded the same to the second respondent vide proceedings dated 06.05.2026. However, no effective steps have been taken pursuant thereto till date. Aggrieved by the inaction on the part of the authorities, the petitioner has filed the present Writ Petition. 5.The learned counsel for the petitioner further submitted that the petitioner would be satisfied if this Court issues a direction to the second respondent to implement the proceedings of the third respondent dated 06.05.2026, after affording an opportunity of hearing to the respondents 4 to 7, within a time frame to be fixed by this Court. 6.Considering the limited relief sought for by the petitioner, and without going into the merits of the matter, this Court directs the second respondent to take appropriate action pursuant to the proceedings of the third respondent in Na.Ka.Aa7/1571/23 dated 06.05.2026, after affording an 4/7
opportunity of hearing to the petitioner and the respondents 4 to 7, and pass appropriate orders in accordance with law, if there is no legal impediment, as expeditiously as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order. 7.With the above directions, this Writ Petition is disposed of. No costs.
