Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 2nd respondent to issue a joint patta in favour of legal heirs of grandfather Muthupillai (i.e. Vijayalakshmi, Saraswathi, Vairavan, Murugan) with respect to Survey No.72/3 and patta No.869 which is situated at Iravathanallur Village, Madurai South Taluk, Madurai District based on the petitioners representation dated 05.07.2021 For Petitioner : Mrs.A. O R D E R

The petitioner seeks mandamus against the second respondent/Tahsildhar Madurai South Taluk, Madurai District to issue patta in the name of the petitioner and other legal heirs of their grand father Muthupillai. The patta is sought for land in S.No.72/3 in which patta No.869 had been originally given and the lands are situated in Survey No.72/3 and patta No.869 which is situated at Iravathanallur Village, Madurai South Taluk, Madurai District

2. The learned Special Government Pleader however pointed out that in the adangal the land have been classified as 'Oozhiyam' which means that it is a temple land or it is notified temple under the control of the HR&CE . Necessary entries has been made by the second respondent.

3. In this regard the petitioner shall also file a necessary application through online and the said application shall be preferred within three weeks from the date of receipt of a copy of https://hcservices.ecourts.gov.in/hcservices/ 1/2

this order and thereafter within a period of 12 weeks the second respondent shall examine the revenue records and invite the petitioner for enquiry and pass orders in accordance with the revenue records with respect of the land.

4. With the above direction, this writ petition stands disposed of. No costs.
