PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the respondent corporation refer him to medical board to determine his fitness for duty and also direct the respondent corporation to consider him for light duty employment as per medical condition with pay protection, continuity of service, back wages and all other attendant benefits in accordance with Sec. 47(1) of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. 1/4

ORDER

The present Writ Petition has been filed by a Driver employed in the respondent transport Corporation seeking a mandamus to refer him to Medical Board to ascertain his fitness for duty and for a direction to consider him for light duty employment.

2.A perusal of the records reveal that the petitioner has given a representation to the first respondent on 15.04.2025, for referring him to the Medical Board. The same has also been acknowledged by the first respondent. A reminder letter has been sent by the petitioner on 05.06.2025. Despite the same, there is no response from the transport Corporation. Hence, the present Writ Petition.

3.Considering the above said facts, the respondents are directed to consider the representation of the petitioner dated 15.04.2025, and pass orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

4.With the above said observations, this Writ Petition stands disposed of. No costs.
