ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 353 and 379 of IPC and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.384 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that on 10.12.2020 at about 09.20 p.m., the petitioner along with other accused were found in illegal possession of two units of river sand. Hence, the compliant. 3.Learned Counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution, but, a false case has been foisted as against him and after a lapse of four months, no arrest has been made.

4.Learned Additional Public Prosecutor appearing for the respondent police submitted the petitioner is having several previous cases to his credit and the petitioner is the habitual offender. 5. Taking into consideration the allegations and also the bad antecedent of the petitioner and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
