For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 369 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 379 of IPC and Section 21(1) of Mines and Minerals Development and Regulation Act 1957, in Crime No.369 of 2021, seeks anticipatory bail.

2.On perusal of CD file, it shows that the petitioner was formally arrested and remanded by the respondent police in another case, in the presence of prison authorities on 11.10.2021. However, the request for issuing P.T warrant has been made before the concerned Court and the same is pending without any progress. 3.The learned Government Advocate(Crl.side) would submit that five previous cases are pending against the petitioner. 4.The petitioner was formally arrested by the respondent police in another crime number, he was remanded. At this state, the anticipatory bail may not lie.

5. Considering the facts and the circumstances of this case and also the fact that the request for PT warrant is pending before the concerned Court without any progress, this Court directs the petitioner to approach the Concerned Court after receiving the summons and seek appropriate relief through proper proceedings. With the above said liberty, this Criminal Original Petition is disposed of.
