ORDER

This writ petition has been filed for a Mandamus to direct the first respondent i.e., District Collector, Ramanathapuram to take action for disbursement of the balance amount of Rs.77,564/- to the petitioner by the Managing Director, Central Co-operative Bank, Ramanathapuram.

2. The petitioner claims that he has suffered a crop loss due to drought and it is covered by the insurance scheme floated by the respondents under the Crop Insurance Scheme (National Agricultural Insurance Scheme).

3. The learned counsel for the petitioner submits that the petitioner is entitled for a sum of Rs.1,75,780/-. However, the respondents have paid only a sum of Rs.98,216/- and leaving a balance amount of Rs.77,564/-. 2/5

4. The learned Government Advocate for the respondents 1, 2 and 4 and the learned counsel for the third respondent submits that the concerned insurance company has not been impleaded. Therefore, the writ petition is liable to be dismissed.

5. On a specific query as which of the respondents were responsible for assessing the crop loss under the aforesaid scheme, it is informed that it would be the revenue authorities.

6. Considering the fact that the first respondent is already here, who is the nodal authority for the loss sustained by an agriculturist, this writ petition is disposed at the time of admission by directing the first respondent to consider the petitioner's representation dated 29.07.2024 as expeditiously as possible preferably within a period of 6 weeks from the date of receipt of a copy of this order. It is needless to state that the concerned insurance company shall be heard before passing final orders on the aforesaid representation of the petitioner. No costs.
