PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the fourth Respondent in his proceedings in C.No.08/P1/F2PS-MNP/2023, dated 23.07.2023 and quash the same as illegal and consequently directing the Respondents 1 to 5 to permit the petitioner to conduct Aadi Festival at Arulmigu Sri Kaliamman Temple, Kumarampatti Inam Puduvadi, Manapparai Taluk, Trichy District on 06.08.2023. This Writ Petition is filed seeking for a direction to the respondent Police to provide suitable protection for conducting of Aadi festival on 06.08.2023 basing on the representation given by the petitioner. 2/6

2. Heard the learned counsel for the petitioner.

Learned Government Advocate (Criminal Side) submits that the petitioner, belonging one of the groups has reported before the Deputy Superintendent of Police / Respondent No.4 that this year they did not want to celebrate the temple festival but have filed this petition for a permission to conduct the festival of the temple. It is submitted that if the temple festival is allowed to be conducted this year without taking other group into confidence, there is every likelihood of law and order problem, thereby the representation given by the petitioner has already been disposed of on 23.07.2023 rejecting the permission.

4. It is however submitted by the petitioner that both the groups are intending to celebrate the festival. In view of the above, the petitioner is at liberty to file fresh application before Respondent No.4, on which, respondent No.4 may enquire the same with all the parties and groups concerned and take into consideration the issues with regard to law and order problem and finally, take a decision and in case, if the situation is conducive for conducting the programme, the permission may be given keeping in view of the fact that the festival is scheduled on 06.08.2023.
