JUDGMENT
(Judgment of the Court was delivered by N.SESHASAYEE. J.)
1. On 23.04.2024, when the matter came up before this Court, this Court passed the following order:
"It is a matter where the appeal now survives for considering the limited question of whether the appellant would be eligible for notional promotion inasmuch as he has retired. He challenges the prospectus for providing promotion as well as the method by which the private respondents have granted promotion. In all, he had arrayed totally 66 private respondents who are all arrayed as respondents 4 to 69.
2. The learned Additional Advocate General, on instructions, submits that out of 66 private respondents, 52 had already retired and the appellant essentially seeks notional promotion for the
vacancies which are filled up through respondents 56 to 68. However, for not taking steps to them, the appeal itself stand dismissed against respondents 56 to 68.
3. This Court underscores that even if appellant made challenge to the prospectus, yet there must be a purpose that must be served through the challenge as of today. This Court does not undertake any academic exercise of testing the validity of any prospectus unless it may benefit the appellant in a certain way.
4. Mr.T.Lajapathi Roy, learned Senior Counsel appearing on behalf of the appellant seeks time to get instructions."
2. Today when the matter is taken up, Mr.T.Lajapathi Roy, the learned Senior counsel appearing on behalf of the appellant, on instruction submitted that he is not pressing the appeal. The Writ Appeal is accordingly dismissed as not pressed. No costs. Consequently, the connected Miscellaneous Petition is closed.
