PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to issue a direction, directing the first respondent to withdraw the case in Crime No.299/2019, pending before the second respondent and entrust the same to any other officer not below the rank of the Deputy Superintendent of Police for investigation based on the petitioner's representation, dated 04.10.2021 by this Court.

ORDER

The criminal original petition has been filed seeking a direction to the first respondent to withdraw the case in Crime No.299/2019, pending before the second respondent and entrust the same to any other officer not below the rank of the Deputy Superintendent of Police for investigation based on the petitioner's representation, dated 04.10.2021 by this Court. 2.The learned Government Advocate (Crl.Side) would submit that so far they have examined 4 witnesses. However, the accused is absconding and yet to secure the accused. Further he stated that if the investigation is transferred to any other investigating https://hcservices.ecourts.gov.in/hcservices/ 1/2

agency, it will affect the entire investigation, which has already been done by the second respondent.

3.In view of the above, the second respondent is directed to complete the investigation and file final report in Crime No.299/2019, within a period of twelve weeks from the date of receipt of a copy of the order. Further, the first respondent is directed to monitor the investigation done by the second respondent.

4.With the above direction, the criminal original petition stands disposed of.
