Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned result published in the internet dated nil by the respondent and quash the same and consequently direct the respondent to consider the petitioner for appointment under Inter- Caste Marriage Priority for the post of Mathematics in TET Paper- II for the year 2012-2013. JUDGMENT

(Judgment of the Court was delivered by PUSHPA SATHYANARAYANA,J.) This Writ Appeal is directed against the order dated 20.08.2014 passed in W.P(MD)No.13754 of 2014.

2. The writ petitioner had attended the Tamil Nadu Teachers Eligibility Test-II conducted by the Teachers Recruitment Board for the post of School Assistant in the year 2012-2013. His claim is that he comes under the category of Inter-Caste marriage and that he was not given preference under the Inter-Caste marriage category. https://hcservices.ecourts.gov.in/hcservices/ Page 1/2

W.A(MD)No.1451 of 2014 However, the learned single Judge had dismissed the writ petition on the ground that the challenge was made only in the year 2014 and there was no reason for the delay and laches explained by the petitioner.

Mr.V.R.Shanmuganathan, learned counsel appearing for the respondent would submit that G.O.Ms.No.188, Personnel and Administrative Reforms (Per.P) Department, dated 28.12.1976, which categorizes that preference to inter-caste marriage candidates is applicable only to the recruitment through employment exchange. Therefore, the writ petitioner who has appeared in the regular recruitment exams is not entitled for the preference under the said category. Besides there is also no challenge to the said Government Order so far.

4. After 2012-2013, it is stated that there were examinations conducted by the Teachers Recruitment Board for TET for more than three times. Therefore, there is no merits in the case of the appellant and hence, this writ appeal is dismissed and the order of the learned single judge dated 20.08.2014 passed in W.P(MD)No.13754 of 2014, is hereby confirmed. No Costs. Consequently, connected Miscellaneous Petition is closed.
